Chapter I General Provisions

Article 1 In order to regulate the ship transport market, strengthen supervision and management, safeguard the legitimate rights and interests of ship transport operators, passengers and cargo owners, protect the safety of people's lives and properties, optimize the capacity structure, and promote the healthy development of the waterway transport industry, according to the relevant state laws and regulations, the formulation of these provisions.

Article 2 These provisions apply to the People's Republic of China coastal, rivers, lakes and other domestic navigable waters of the ship transportation business qualification management.

Article III of the ship transport business according to the ship navigation area is divided into coastal ship transportation and river ship transportation. According to the type of ship operation is divided into cargo ship transportation and passenger ship transportation. Cargo ship transportation is divided into ordinary cargo ships, bulk liquid dangerous goods ship transportation (liquefied gas ship, bulk chemical ship, tanker transportation) (hereinafter referred to as "liquid dangerous goods ship transportation"). Passenger ship transportation is divided into ordinary passenger ships (passenger ferries), passenger-roller ships (car passenger ferries), high-speed passenger ship transportation.

Article IV operating domestic ship transport enterprises and individuals, in accordance with the provisions of this regulation and the relevant provisions of the State, to obtain the appropriate business qualifications, and in the approved business qualifications within the scope of domestic ship transport business activities.

Article 5 the competent departments of the people's governments at all levels of transportation in accordance with law on the implementation of the management of domestic ship transport business qualification, and can be entrusted to set up the shipping agency responsible for the management of domestic ship transport business qualification management of the specific work.

Chapter II qualification conditions

Article 6 in addition to the inland waterway general cargo ship transportation, ship transportation should obtain corporate qualification.

Article VII establishment of passenger, liquid cargo and dangerous goods ship transport enterprises, at least one shareholder with a shareholding of more than 25% has more than 3 years of the corresponding ship type of sea and river ship transportation experience. Apply for the operation of coastal, inland waterway passenger ship transportation, should have more than 3 years of the corresponding sea, inland waterway cargo ship transportation experience; apply for the operation of coastal, inland waterway roll-on/roll-off transportation, should have more than 3 years of the corresponding coastal, inland waterway passenger ship transportation experience; apply for the operation of the liquid dangerous goods ship transportation, should have more than 3 years of the corresponding sea, inland waterway general cargo ship, passenger ship transportation experience.

Article VIII of the enterprise business ship transport should meet the operational needs and safety management requirements of the organization, fixed office space, according to the relevant provisions of the state to establish, implement and maintain a safety management system.

Article IX engaged in ship transportation should meet the following conditions.

(a) more than half of the enterprise ship transport management personnel should obtain the Ministry of Transportation recognized institutions issued by the practitioner's qualification certificate or to obtain shipping, navigation, ship, ship engine and other professional secondary professional (inland waterway transport, vocational high school) or above.

(B) individual operators should obtain a training certificate issued by a recognized institution of the provincial transportation authority;.

(E) enterprise sea, engine management personnel hold with the type of ship operating sea and river vessels corresponding to no less than the first mate, chief steward's certificate of competency.

(D) the enterprise should have more than 4 full-time management personnel, and management personnel and the enterprise signed a labor contract for more than 2 years;.

(E) the operation of passenger, liquid cargo and dangerous goods ship transportation, at least one of the top management to obtain the corresponding passenger ships, dangerous goods ship captains or chief engineers certificate of competency; sea and engine management should also be held with the type of ship operation of sea and river vessels corresponding to the captain, chief engineers certificate of competency.

Article 10 The ships operating ship transportation shall obtain the Ship Inspection Certificate, Certificate of Ship Nationality, Certificate of Minimum Safe Manning of Ships and Ship Operation Certificate in accordance with the regulations.

Article 11 Enterprises and individuals operating ship transportation shall own ships that are appropriate to the scope of the operating area and the types of ships. In addition to the closed navigable waters in the provinces, autonomous regions and municipalities directly under the Central Administrative Region of the passenger ship transportation enterprises, ship transport enterprises have the corresponding total capacity should meet the following minimum requirements: (a) the operation of passenger ship transportation in the closed navigable waters of the municipalities directly under the Central Administrative Region of the passenger ship transportation enterprises.

(a) operating coastal general cargo ship transport: 2000 deadweight tons of general cargo ship; (b) operating coastal general cargo ship transport: 2000 deadweight tons of general cargo ship; (c) the total capacity of the ship transport enterprise shall meet the following minimum requirements.

(B) operating coastal liquid cargo ship transport of dangerous goods: dangerous goods ship 2000 dwt, including the operation of liquefied gas ship transport: 2000 cubic meters of capacity;.

(C) the operation of coastal passenger transport: ordinary passenger ships at sea 400 passengers, high-speed passenger ships 200 passengers, roll-on/roll-off ship 3000 dwt / 400 passengers.

(D) the operation of inland waterway liquid cargo dangerous goods ship: dangerous goods ship 300 deadweight tons, which operates inland waterway liquefied gas ship transport: 300 cubic meters of cabin capacity.

(E) operating inland waterway passenger transport: inland waterway ordinary passenger ships, high-speed passenger ships 50 passengers; operating inland waterway passenger transport (car passenger ferry), roll-on/roll-off ship (car passenger ferry) 1500 deadweight tons / 50 passengers.

Article XII of the operation of ship transportation, there should be in line with national regulations of the registered capital.

Article XIII of the operation of passenger routes, should implement the ship berthing, passenger embarkation and disembarkation of the necessary service facilities.

Chapter business qualification approval

Article XIV application for operating ship transportation, shall submit the following corresponding declaration materials.

(a) application; (b) feasibility study.

(B) feasibility study report (including organizational setup, management staffing, basic enterprise management system).

(E) notification of pre-approval of enterprise name and its copy.

(D) "Enterprise Legal Person Business License Copy", "Business License Copy" and its copy.

(E) Certificate of Ship Inspection, Certificate of Ship Ownership Registration, Certificate of Ship Nationality and its copy.

(f) the main management personnel ID card, qualifications, education, training certificates, certificates of qualification, labor contracts (preparatory work, to provide the agreement of intent), "minimum safety crew certificate" (application for the opening of business to provide) and its photocopies.

(t) apply for business, to shareholders' qualifications, banks or asset evaluation agencies to issue documents certifying the creditworthiness or other documents that can illustrate the shareholders' investment.

(H) the state requires the establishment of a safety management system, should provide "proof of compliance" certificate or "temporary compliance certificate" and its copy.

(Ix) operating passenger transportation, the ship berthing, passenger boarding and disembarkation of the necessary service facilities documents.

Article XV of the enterprise, individual preparations should be submitted to the provisions of Article + 4 (- -) to (3), (6), (7), (9) of the required declaration.

Article 16 enterprises, individual business shall be submitted to the provisions of Article 14 (1-), (5) to (9) of the required documents and preparatory documents for approval.

Article 17 shall apply for operating ship transportation in accordance with the "Regulations of the People's Republic of China on the Implementation of the Regulations on Waterway Transportation", "inter-provincial waterway transport enterprises for approval of the management of" the approval of the authority to the competent department of transportation] to submit the declaration materials provided for in the provisions of this regulation. The competent traffic department [department shall] accept the application to verify the originals and copies of the declaration materials, conduct a comprehensive review in accordance with the business qualification conditions stipulated herein and the relevant state regulations, and forward them to the competent traffic department [department] with approval authority for approval on a level-by-level basis.

Article 18 belongs to the application for the operation of passenger transport, passenger roll-on/roll-off, high-speed passenger transport, liquid cargo and dangerous goods ship transport, the city (district city) traffic department] shall, within 30 days of receipt of the declaration materials, based on the declaration materials and field investigations, whether the applicant meets the qualification conditions for ship transport operations to carry out a comprehensive assessment. Considered eligible, write an assessment report, and forwarded to the provincial transportation department in charge of the audit; that do not meet the conditions, shall notify the applicant in writing, and explain the reasons. Belong to the application for preparatory work, should be based on the qualification conditions of ship transportation business to assess the feasibility of the application. Provincial transportation authorities should be based on the actual situation, the application for the operation of high-speed passenger ships, passenger roll-on/roll-off ships, liquid cargo and dangerous goods ship transportation for reassessment. The Ministry of Transportation water system sent agencies on the application of the objectionable matters, shall, in conjunction with the relevant provincial transportation department [ ] for reassessment.

Article 19 of the ship transport business qualification approval process, the provisions of this regulation does not provide, according to the "People's Republic of China Waterway Transportation Management Regulations Implementation Rules",

Measures for Approval and Administration of Interprovincial Waterway Transportation Enterprises".

Article 20 of the ship transport operators to change the scope of business or cease and desist, should be in accordance with the "People's Republic of China Regulations for the Implementation of Waterway Transportation Management", "Interprovincial Waterway Transportation Enterprises Approval of the Management Measures" to the original approval authority to apply for the appropriate procedures. Enterprises, individuals to change the scope of business shall provide the provisions of Article + 4 (- -), (= -), (d) to (ix) declarations and waterway transport license (copy).

Chapter IV business qualification supervision and inspection

Article 20 - the Ministry of Transportation [department in charge of ship transport qualification supervision and inspection, and in accordance with relevant state regulations to implement administrative penalties.

Article 22 of the ship transport operators to accept the ship transport qualification supervision and inspection, should truthfully provide the necessary proof, documents and other relevant information.

Article 23 of the ship transport operators after the opening of business does not meet the requirements of business qualifications, the competent department of transportation] shall order its rectification within a certain period of time; after rectification still does not meet the requirements of business qualifications, order to stop the ship transport business activities.
